Privacy Policy

This privacy policy applies to all personal data processed by our company and to all personal data processed by companies commissioned by us (processors). With the term personal data, we refer to information within the meaning of Article 4 No. 1 GDPR, such as the name, email address and postal address of a person.

Legal basis

In the following privacy policy, we provide you with transparent information on the legal principles and regulations, i.e. the legal bases of the General Data Protection Regulation, which enable us to process personal data.

  2. Legitimate interests (Article 6 Paragraph 1 lit. f GDPR): In the case of legitimate interests that do not restrict your basic rights, we reserve the right to process personal data. For example, we have to process certain data in order to be able to operate our website securely and economically. Therefore, the processing is a legitimate interest.


Other conditions such as making recordings in the interest of the public, the exercise of official authority as well as the protection of vital interests do not usually occur with us. Should such a legal basis be relevant, it will be disclosed in the appropriate place.

2. How we collect and use your personal data

2.1 Agent Response is used by "Respondents." For the purpose of this Privacy Policy, Respondents are persons who answer or respond to those forms or where they have submitted their data to us via third parties. The estate agent (“Customer”) that listed the property or that you have contacted directly using one of our forms.



For the purposes of the GDPR, you acknowledge that by providing your personal information to us as a Respondent, the collection of such personal information takes place outside the European Economic Area ("EEA") and that it is necessary for the provision of the Services to Process such personal information outside the EEA and that such personal information may then be stored on servers outside the United Kingdom. In relation to the collection of such personal information you acknowledge that both these scenarios do not constitute a "transfer" of personal information from within the EEA to outside the EEA by us.

2.2 Processing data

2.2.1 As a Processor: Respondents, when completing a form, may divulge personal information or data. Agent Response is not responsible for the content of the Customer's form, and all processing of Respondents' personal information will be subject to the Customer's own privacy policy.


We act as a processor for the information you provide, the estate agent that listed the property or you have contacted is the controller. Where we process the personal information of Respondents, Agent Response acts as a data processor for the purposes of the GDPR, as we only process that personal information on behalf of the Customer and as instructed by the Customer, unless otherwise described herein.


The Customer has responsibility for and manages the processing of data collected from forms and all Respondents and/or Customers who divulge personal information of third parties are solely responsible for obtaining the consent (if required) and notifying such third parties before divulging their personal information to us. Please contact the Customer directly if you have any questions about the Customer's privacy policy.


2.2.2 As a Controller: Respondents, when completing a form, may be asked if they are interested in additional services they may require. In the event that the respondent says Yes to needing these additional services, Agent Response will be a controller of the information they have provided via the form.


In this case, the Respondent has shown a legitimate interest in being contacted about additional services they are interested in, this information may be shared with relevant third parties that are able to provide the services the Respondent has shown an interest in.


2.2.3 We may gather certain types of information on Respondents in order to provide our Services. The information we collect includes:

  • initial enquiry information from a 3rd party site
  • The information Respondent enters into a form, before the Respondent completes or submits the form in order to prevent the inadvertent loss of Respondent's response; and
  • Respondent's email address if the Customer provides it to us to send the Respondent an invitation to complete a form by e-mail.


If we did not process Respondent's information in this manner, we could not provide these features.


We collect and store this information from Respondents to fulfil both our contract with the Consumer and our legitimate business interests in the proper delivery of our products and Services.


We may also process additional personal information from Respondents on the basis of fulfilling our legitimate interests of improving and developing the quality of our products and Services, and better understanding your needs in an effort to provide our clients with the highest level of services. Under this basis, we may collect such additional personal information from Respondents, including the following:


(a) Usage data about the Respondent whenever the Respondent interacts with Agent Response's Services.


(b) Data from the device and application the Respondent uses to access Agent Response's Services, such as Respondent's IP address, browser type and operating system.


(c) Information about the source that referred the Respondent to Agent Response such as a link on a website or in an email.


(d) Aggregated and other pseudonymous data about Respondents through the use of cookies, page tags and other tracking services.


(e) Where the Respondent has shown an interest in being contacted about additional services they need and share this information with relevant third parties.

3. Children's information

This Website is not directed to nor is it intended for any individuals under the age of 18, EU individuals under the age of 16 or UK individuals under the age of 13 (each individually a "Child" or collectively "Children") and we do not knowingly solicit or collect information from Children. If you are a Child, do not use or provide any information on this Website. If we learn we have collected or received personal information from a Child, we will delete that information. 4.1 Agent response may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers, analytics and email service providers or subcontractors insofar as reasonably necessary to perform the tasks we request of them and they are not authorized by us to use or disclose your information except as necessary to perform services on our behalf or to comply with legal requirements.

4.2 Agent Response may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.


4.3 Agent response may also disclose your personal information to third-parties when necessary to protect the copyright, trademarks, legal rights, property or safety of Agent Response, our Website, our Services, our customers or third parties.


4.4 If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to disclose to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases based on our legitimate business interests, as discussed above. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

5.1 Agent Response reserves the right to review, alter, update and/or remove portions of this Privacy Policy in the future. We may modify this Privacy Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. Please check back from time to time to review our Privacy Policy. Changes to this Privacy Policy are effective as of the last updated date provided above. By using our Website and/or the Services, you accept the version of this Privacy Policy in place at that time.

6.1 The Agent Response forms may include links to third party websites. Agent Response does not control nor does it have control over third party websites.
